An epidemic of a deadly strain of Salmonella has swept across the whole of Africa by "taking advantage" of the spread of HIV, according to an international team of researchers.
Their study, published in Nature Genetics, is the first to identify the separate cases as a single epidemic.
One in four people in Africa infected with the strain died.
It is thought to be the first time a single strain of an infection has spread so widely in the wake of HIV.
Cases of this form of invasive non-typhoidal Salmonella have been recognised in Africa for more than a decade. It causes fever, headaches, respiratory problems and sometimes death.
Continue reading the main storyEnd Quote Prof Gordon Dougan Sanger InstituteIt quite clearly parallels the emergence of HIV in Africa?
The research team analysed the genetic code of 179 batches of Salmonella from different parts of Africa and the rest of the globe. Using techniques similar to a large-scale DNA paternity test, they were able to construct the strain's "family tree" and then how it spread.
It happened in two waves. The first started in south-eastern Africa about 52 years ago and the second wave started 35 years ago from the Congo Basin.
Prof Gordon Dougan, from the Sanger Institute in Cambridge in the UK, told the BBC: "It quite clearly parallels the emergence of HIV in Africa."
HIV attacks the immune system and leaves people more vulnerable to other infections. It is thought the strain of Salmonella Typhimurium took advantage of this weakness and spread. The research team said the bacterium was given the chance to "enter, adapt, circulate and thrive".
There is poor monitoring data for the disease across the whole of the continent, but Prof Dougan said it was affecting "thousands and thousands" of people and that 98% of adult cases were in people with HIV.
Continue reading the main storyEnd Quote Prof Brendan Wren London School of Hygiene and Tropical MedicineIt's actually quite a huge problem and it seems to be getting worse because there are many susceptible people, it's got a grip in Africa?
He said this spread of Salmonella Typhimurium had been different to that of other infections commonly associated with HIV, as it had been a single epidemic "people were completely unaware" of and there "were not really any other examples" of that happening.
Dr Melita Gordon, a gastro-enterologist at the University of Liverpool, said: "It's the first time this has been described right across a continent in such an obvious way."
She added: "The highest mortality associated with the disease is 80%. What's happened over the years is mortality has fallen down and down and down to between 20% and 25% as doctors inside Africa recognise it."
The genetic analysis also showed the strain was resistant to the first choice antibiotic, chloramphenicol, which means more expensive drugs would be needed to treat the infection.
It is thought that improving HIV treatment across Africa could reduce the prevalence of the Salmonella infection, as it would reduce the number of people with vulnerable immune systems. However, the researchers urged "vigilance" in case the Salmonella strain mutated again to become able to infect people with healthy immune systems.
Commenting on the study, Prof Brendan Wren, from the London School of Hygiene and Tropical Medicine, told the BBC: "It's actually quite a huge problem and it seems to be getting worse because there are many susceptible people, it's got a grip in Africa.
"HIV, I think it's fair to say, provided a springboard for it to take off."
However, he thought the disease was "near its peak" as HIV was more controlled in other continents giving it little room to spread.

Recently, the research and consulting firm Millennial Branding firm teamed up with the career networking site Beyond.com to survey more than 5,000 job seekers about their job search. And they found that Baby Boomers -- folks in their late forties to sixties -- are having the toughest time finding jobs compared to other generations.
According to the study's findings, Boomers are searching the longest compared to Generation X or Gen Y. In fact, 25 percent of Boomers have been hunting for jobs for more than a year, while only 17 percent of Gen X and 10 percent of Gen Y have waited more than one year to land a job.
Even more importantly, 65 percent of Boomers feel employers have discriminated against them because of their age.
These results aren't a huge shocker -- there are plenty of reasons why employers might be wary of bringing older folks on board.
"They cost too much, might not seem relevant with the times, or don't fit with the corporate culture (if it's a young startup for instance)," suggests Dan Schawbel, a Gen Y expert and founder of Millennial Branding.
So what can you do about it? Schawbel offers some tactful tips for older folks looking to combat age discrimination:
1. Don't give away your age in the resume. Schawbel suggests you pull up your resume and get rid of any work history that didn't take place in the last 10 years.
Next, it's time to do away with any college graduation dates and "potentially eliminate all dates," Schawbel says. He also suggests you downplay your job titles. "Especially if they're a sign that you are older, such as an EVP title," he says.
Bonus tip: "On your LinkedIn profile, don't include your picture if it portrays you as looking old," Schawbel adds.
2. Keep your skills current. This is a given -- no matter how many years of experience you've had in your field, there's always more to learn. Technology is changing rapidly and this impacts every industry.
Show employers that you're eager to adapt and keep learning by seeking out certification and classes on the latest software, database, or whichever application bolsters efficiency in your field. The educational media site Open Culture offers a great comprehensive list of 500 free online educational resources to help you stay relevant.
3. Networking is your best bet. As Boomers, you've developed a larger network over the years than any other generation. Use this to your advantage by "tapping your network," Schawbel says. It's "the best path to finding work." In fact, in their study, Schawbel and his team found that Boomers are job searching online more than younger generations, and that "they are especially using LinkedIn."
If you're not leveraging both online and offline networks, you're missing out on huge opportunities. "It's important that [Boomers] use all of their resources in order to get referrals," Schawbel says. "It's their biggest advantage over younger workers."

September has come to an end, surprisingly. Fall tried to bestow her crisp beginnings on us, and now October is waiting just around the corner. And if you have yet to spruce up your home to welcome the beloved harvest time, then check out Tower View Farm on Taylorsville Road this Saturday, September 29.
Tower View Farm is a roadside market full of small farm quaintness. My family and I frequent it every autumn for those cherished gourds, mums, pumpkins, hay bales, and unique butters you can only find this time of year. This Saturday, September 29, they are hosting a family day full of fun.
Last year we took the short but perfect hayride out to the pumpkin patch. We grabbed a wagon sitting around the property and filled it with pumpkins and flowers. We went inside to the tiny family run market and bought some homemade jam. And we left with our car full of goodies and that feeling of pride when you support those local farmers just trying to make a living.
On Saturday, September 29 you can drive out to Tower View Farm and enjoy all these free activities, plus listen to some live music by Meadow Ryann. The farm opens at 8am, with music starting at 1:30pm. They are located at 12523 Taylorsville Road in Jeffersontown near the Gene Synder exchange. Call 267-2066 for more information.

In the letter he says, Apple is "extremely sorry" for releasing a subpar product and "we are doing everything we can to make Maps better."
He even tells customers to try other apps while Apple fixes its maps: "You can try alternatives by downloading map apps from the App Store like Bing, MapQuest and Waze, or use Google or Nokia maps by going to their websites and creating an icon on your home screen to their web app."
We're floored. This is very unlike Apple. But, it's a new era at Apple with Tim Cook in charge. And really, he didn't have much wiggle room. Apple was and is getting hammered over its faulty maps app.
Here's the letter:
To our customers,
At Apple, we strive to make world-class products that deliver the best experience possible to our customers. With the launch of our new Maps last week, we fell short on this commitment. We are extremely sorry for the frustration this has caused our customers and we are doing everything we can to make Maps better.
We launched Maps initially with the first version of iOS. As time progressed, we wanted to provide our customers with even better Maps including features such as turn-by-turn directions, voice integration, Flyover and vector-based maps. In order to do this, we had to create a new version of Maps from the ground up.
There are already more than 100 million iOS devices using the new Apple Maps, with more and more joining us every day. In just over a week, iOS users with the new Maps have already searched for nearly half a billion locations. The more our customers use our Maps the better it will get and we greatly appreciate all of the feedback we have received from you.
While we?re improving Maps, you can try alternatives by downloading map apps from the App Store like Bing, MapQuest and Waze, or use Google or Nokia maps by going to their websites and creating an icon on your home screen to their web app.
Everything we do at Apple is aimed at making our products the best in the world. We know that you expect that from us, and we will keep working non-stop until Maps lives up to the same incredibly high standard.

Programming note: D'Backs-Giants coverage gets underway tonight at 6:30 p.m. on Comcast SportsNet Bay Area
The Giants are expected to announce today that Melky
Cabrera, currently serving a 50-game suspension for testosterone use,
will not be part of the Giants' postseason roster, CSNBayArea.com has learned.
My understanding is Cabrera is disappointed, but he and his reps do not plan on filing a grievance in response to the club's decision.
Cabrera, a switch-hitting left fielder, had a .346 average and was leading the major leagues in both hits and runs scored when his positive test was announced Aug. 15. The Giants have gone 25-12 since the suspension while cruising to the NL West title.
Cabrera would have been eligible to play in the Arizona instructional league beginning Saturday.

This isn?t what the law?s backers said would happen. Republican state Senator Scott Beason, a sponsor, said at a news conference last year that the restrictions on undocumented workers would ?put thousands of native Alabamians back in the work force.?
Instead, it caused a labor shortage that resulted in the importation of hundreds of legal African and Haitian refugees, and Puerto Ricans, according to interviews with workers, advocacy organizations and businesses. Most were recruited by the poultry industry, in a segment of the economy that has been a heavy employer of undocumented workers, according to the Pew Hispanic Center, a Washington research group.
Alabama is one of five states that last year passed immigration laws modeled on a 2010 Arizona measure largely invalidated by the U.S. Supreme Court in June. Last month, an appellate court in Atlanta said many of the Alabama law?s requirements also aren?t constitutional. Other provisions, including one allowing police to arrest suspected illegal immigrants, remain in place.
Destination: Albertville
In Albertville, a city of about 21,000 in the northeast corner of the state, Manga, his friend Abrahaley Araya and about 18 other African refugees started at Wayne Farms LLC?s plant in the days after the law took effect a year ago, according to the two men and Albert Mbanfu of Lutheran Services of Georgia, which helps refugees find jobs.
Johnell Rodriguez, 26, said he was among 17 Puerto Ricans who arrived at another Alabama Wayne Farms plant a week after the law took effect. Haitian Saul Jules said he was recruited in Miami to work in Albertville by JBS SA (JBSS3)?s Pilgrim?s Pride Corp. a few months ago.
Plants sought refugees because too few local residents were interested or qualified, said Frank Singleton, a spokesman for Wayne Farms, based in Oakwood, Georgia.
Many legal Hispanic employees left after the immigration law took effect, he said. The company, which operates six plants in the state, spent $5 million to replace and train new workers, he said. Turnover in North Alabama was 50 percent last year, and is now as high as 90 percent in some plants because replacements didn?t stay, he said. The company is ?having to use alternative methods and sourcing,? including recruiting refugees, Singleton said.
Wayne Farms found Eritreans, displaced by war and conflict, and other Africans through East Coast Labor Solutions LLC, a Fairlea, West Virginia-based labor broker. East Coast has about 200 workers in Alabama, owner Ray Wiley said in an interview.
?Our jobs are often in states where immigration laws have hit the hardest, and mostly in the poultry industry,? he said.
East Coast began calling Atlanta refugee agencies several months ago looking for legal immigrants to come to Alabama for a year, said Mbanfu, refugee employment director for Lutheran Services in Atlanta. He said the company would have taken as many refugees as he could refer.
The agency connected East Coast with refugees who had been in the country three to five years, he said.
Chris Gaddis, head of human resources for Greeley, Colorado-based Pilgrim?s Pride, which has four plants in Alabama, said the law didn?t affect its workforce. Worth Sparkman, a spokesman for Tyson Foods Inc. (TSN), which has two plants in Alabama, also said there was no effect.
Alabama doesn?t track the number of refugees who come to fill jobs. The state had an estimated 120,000 illegal Hispanic immigrants in 2010, of whom 95,000 were in the labor force, according to the Pew Hispanic Center. They were 2.5 percent of the population and 4.2 percent of the workforce.
Changing demographics are reflected on store shelves. Albertville?s main Hispanic grocery, Tienda El Sol, added coconut milk, new varieties of hot peppers and other items to appeal to newcomers, manager Marjorie Centeno said.
The Alabama law?s intent was to attack ?every aspect of an illegal alien?s life,? and ?make it difficult for them to live here so they will deport themselves,? Republican House sponsor Micky Hammon said during legislative debate, according to a Birmingham News report.

Fitness trackers, like the people they're meant for, come in plenty of shapes and sizes. The latest addition to this category of wearable devices that act essentially like pedometers, only smarter, is the petite Fitbit Zip.?Our Editors' Choice for fitness gadgets is the outstanding Fitbit Ultra, a sleek and compact device that provides a wealth of easy-to-understand information about your health. However, the company will soon retire the product and replacing it with two new options: the soon-to-be released Fitbit One, which is very similar to the Ultra except with modified look, and the tinier, lower-cost Fitbit Zip.
At $59.95 (direct), Fitbit Zip caters most to price-sensitive folks. No other good-quality fitness gadget I've seen comes in under $99, from the bracelet shaped Nike+ FuelBand ($149) to the boxy MP3-playing? Motorola MotoActv ($249.99) . If cost is your primary concern in choosing a fitness tracker, Fitbit Zip may be an ideal option.
However, given the mere $30 price difference between Zip and the new Fitbit One, I'd rather pony up for the latter. Fitbit Zip does an admirable job of counting steps taken and miles walked or run, but it lacks a few features that I think are worth the extra money. While I have not yet formally tested Fitbit One, I can safely say based on experience with Fitbit Ultra (and word from the company that functionality will be nearly identical) that the altimeter and sleep data you get with the more expensive gadget are extremely cool. Plus, Fitbit One, which I got some hands-on time with pre-release, has an even more attractive design than Ultra. The Zip, in comparison, looks a little cheap.
Design
When I say Fitbit Zip is tiny, I mean I've eaten pieces of candy bigger than this thing. It's 0.2 by 1.2 by 1.8 inches and weighs 0.3 ounces. Also included in the package are a color-coordinated rubbery case with clip, so that you can secure Fitbit Zip to your clothes, and a USB plug-in device that enables wireless syncing to your Fitbit account (more on that in the Set Up section).
This wireless activity tracker comes in five colors?white, black, lime, magenta, and blue. To me, the white and black look more sophisticated than the other sporty colors, so I opted for a white test unit.
In the center of the plastic body, a simple dot matrix display shows the time, how many steps you've walked (on a midnight-to-midnight cycle), total distance in miles, calories burned, and a happy face to reward you for staying fit. Compared with the slick Fitbit One, the Zip?s gray display looks downright schlocky.
Fitbit Zip has no buttons to press, instead relying on a simple tap to cycle through the information. The display goes to sleep when you?re not active to conserve battery power.
Set Up
Unlike most other fitness tracking devices that need to be connected by a cable to your computer and recharged every so often, Fitbit Zip is entirely wireless and runs on a watch battery, which you can replace when it dies, but should last several months.
Out of the box, you plug in the USB syncing connector into your computer, which initiates a download of the Fitbit software. You'll also see prompts to log into your Fitbit account, or create a new one if you need.
The Fitbit Web account is really the heart of the program, and it works with a number of other apps, such as Lose It! and MapMyRun, as well as physical devices for health and fitness, including the Fitbit Aria Wi-Fi Smart Scale, which automatically logs your weigh-ins to the account to track your weight effortlessly.
For all the Fitbit components to work properly, you do need to enter into the Web account your height, weight, age, and sex. All that information stays private.
With a Fitbit account set up, you can clip Fitbit Zip to your clothes or tuck it in your pocket, and go about your normal day. When you're in range of your computer with the USB stick, all your data will wirelessly upload to your Fitbit account.
Web Account Features
Fitbit Zip will keep track of the ground you cover every day, but it won't count stairs or hills that you climb any differently, as the Fitbit Ultra and One do (climbing stairs burns about four times as many calories as walking on flat surface). All this activity is uploaded to your account, where you can view intuitive graphs of your progress.
You can set up goals, like losing weight or simply taking more steps in a day, and Fitbit will keep an eye on your progress.
The Web account is comprehensive. You can manage your calorie intake by logging foods and drinks you consume, and also entering special activities in addition to walking to ensure you get credit for burning more calories. For example, if you swam three-quarters of a mile in 35 minutes while not wearing the Fitbit Zip?which is water- and sweat-resistant, but can't be worn in a pool?the Web account will computer how many additional calories you burned. Fitbit Zip only tracks walking, jogging, and running, but that's true of nearly every fitness tracker I've seen.
A journal section also appears in your account for keeping notes, as well as areas for monitoring sleep, blood pressure, and glucose if you have the appropriate devices or want to manually enter information.
The Fitbit Ultra and its successor the Fitbit One include automatic sleep tracking data, which I really enjoy seeing, but this capability didn't make it into the lower-cost Fitbit Zip.?
Should You Zip?
Miniscule, yet effective, Fitbit Zip certainly does meet the needs of anyone looking for a good quality fitness tracker at an affordable price. But seeing as you only have to shell out an extra $30 for the upcoming Fitbit One, which will replace Fitbit Ultra (our Editors' Choice), the added cost seems worth it. Fitbit Zip doesn't look as sharp as the Fitbit One, nor does it track your sleep or give you credit for additional calories burned when you climb stairs. And with any of the Fitbit devices, you get the same great Web account for free. The Fitbit Zip might make sense if you're unsure of your commitment to using a fitness tracker in the first place, but for everyone else, I recommend spending just a little more for the Fitbit One.?

NASA's Mars rover Curiosity reached out and touched a Martian rock with its huge robotic arm for the first time, then took off on its longest Red Planet drive to date.
Curiosity spent the past several days investigating a strange pyramid-shaped stone named "Jake Matijevic," testing out some of the gear at the end of its 7-foot-long (2.1 meters) arm. These tools include the Alpha Particle X-Ray Spectrometer (APXS), which measures elemental composition, and the Mars Hand Lens Imager close-up camera, or MAHLI.
The rover performed these initial "contact science" operations on Saturday and Sunday (Sept. 22 and 23), researchers said. Photos snapped on those days show Curiosity's arm sidled up against "Jake Matijevic," with the arm's turret obscuring most of the 16-inch-tall (25 centimeters) rock.
"I did a science! 1st contact science on rock target Jake," the Curiosity team announced Saturday (Sept. 22) via the rover's Twitter feed @MarsCuriosity, which has more than 1.1 million followers. "Here's an action shot." [Curiosity Mars Rover: 11 Amazing Facts]
Curiosity also zapped "Jake Matijevic" with the laser on its ChemCam instrument, which reads rock composition from the vaporized bits. Comparing the results should help cross-calibrate the two instruments, researchers said.
The ChemCam work wrapped up Monday (Sept. 24), at which point Curiosity embarked on a 138-foot (42 m) drive ? the longest one-day jaunt for the rover since it landed inside Mars' Gale Crater on the night of Aug. 5.
Curiosity is making its way toward a site called Glenelg, which lies 1,300 feet (400 m) from the rover's touchdown site. Before Monday's drive, the mission team had said Curiosity was about halfway to Glenelg.
Scientists will likely soon begin looking for sandy areas to try out Curiosity's scooping system for the first time. The arm will deposit bits of Martian soil into the analytical instruments on the rover's body, which are known as SAM (Sample Analysis at Mars) and CheMin (short for Chemistry & Mineralogy).? ?
The first use of Curiosity's rock-boring drill, which also sits at the end of the rover's arm, will come sometime after that, researchers have said.
While team members are keen to see what Curiosity discovers at Glenelg, the $2.5 billion rover's main destination is the base of Mount Sharp. This odd mountain rises 3.4 miles (5.5 km) into the Red Planet sky from Gale Crater's center, and its foothills show signs of long-ago exposure to liquid water.
Those foothills lie about 6 miles (10 km) away from Curiosity's landing site. The rover ? whose main task is to determine if the Gale area could ever have supported microbial life ? may be ready to turn its wheels toward the interesting deposits near the end of the year, scientists have said.
The rock "Jake Matijevic" takes its name from Curiosity's surface operations systems chief engineer, who died Aug. 20 at the age of 64. Matijevic, who was based at NASA's Jet Propulsion Laboratory in Pasadena, Calif., also worked on all three previous Mars rovers ? Sojourner, Spirit and Opportunity ? NASA officials said.

On Tuesdays and Fridays, attorney Joe Escalante answers legal questions for free on the?LegalZoom Facebook Page. Did you miss the last?Free Joe? Don?t worry. We?ve got it all right here.
Kenny: Quick question, I am about to buy a copy write for my work, but I am editing. Now, since my editing will involve correcting typos and some unneeded lines, should I finish my edits first?
Joe Escalante: I would copyright the first serious draft you have. Then leave it alone until it?s published. Unless you make huge changes, that copyright will protect the creative expression of your ideas just fine and you wont need another one.
Denise: i have a question my husband and i live in rock hill sc and he is going to be receiving a a workman compensation settelement i was wondering if i am entitled to any of the monies
Joe Escalante: Some of it, at least, would be considered community property to the extent that it was to replace earnings lost during the marriage due to the injury. The amounts determined to be for future losses of income (say, after the marriage is over) could be argued to be separate property.
Carol: If you are an authorized signed for a credit card, and the primary owner of the card has passed away, and the account will be closed, are you then responsible for the debt?
Joe Escalante: Probably yes. I can?t see them not coming after you.
Jessica: I have legal questions about a neighbor tying into out fence, which means they are on our property. The past month, we?ve had the cops called out because we supposedly have parked on ?his? property (in our front, not back where fence is) and he no longer wants us to cut his grass, which is roughly 2?. Keep in mind, our properties in the front have no fence or border, just grass all the way across
and when the renters (he owns the house but doesn?t live in it), didn?t cut that, we did and no problem at all until now. What can I do to get him to to take the fence off our property? Neither lots have been surveyed and I really can?t afford to pay for one but he is acting like an idiot, even if front of the cop HE called, cussing and screaming etc. He has also sprayed a very crooked line in the grass up to our fence to indicate where ?his? property is. I have those documented with pictures also. Any help to get him off out back without having the land surveyed, would be greatly appreciated.
Joe Escalante: Unless the land is surveyed, the courts wont know where to draw the line for trespassing. You need a survey, or a sit down over coffee to hash out an understanding. These neighbor disputes are deadly. Be calm and work it out.
Tanya: After our upstairs neighbor?s washing machine flooded our unit, our renters insurance covered most of the damage, but we are still left with an unpaid balance that is significant. The upstairs neighbor?s (who is a condo owner) home owner insurance denied our claim stating there was no negligence. Because our unit owner did not have home owners insurance, they were not able to act quickly to fix th
e unit, even though they claim they would have, after the fact. We also incurred move out costs for moving our personal property into storage. We didn?t move back in, but had to clear out our stuff for getting the unit fixed anyway. We also had to sign a waver to not go sue our unit owner, in order to get out of the lease early. There was no explanation why the washer overflowed. Is it worth our time to sue the upstairs neighbor for the remaining balance in small claims court? We have read many times, that if we can?t prove negligence, we are out of luck. Thanks.
Joe Escalante: In small claims court you can be victorious if you can show that another person?s actions caused you harm, even if there was no negligence. He?s responsible for his pipes. That shouldn?t be that hard to get across to the judge. There aren?t a lot of rules in Small Claims. You?re likely to get something for your troubles if you make a decent case with evidence, pictures, and a good court demeanor (politeness).
Ruth: I?m owed just over $600 from an art gallery that has owed me for at least 2 years. Every time I call, he doesn?t answer, or replies email saying he will send money. 2 years ago he gave me 2 checks for about $300 and both bounced. I was charged $12 each check from my bank which I then added to what he owed me. He seems to make up excuses for everyone both sellers and artists. I gave him the option to pay me by credit card or even give me money $50 every couple months and it would have been paid off by now. I don?t trust checks from him anymore. Is there an easy not so expensive way for me to get the money from him?
Joe Escalante: Small claims court would be an easy way to get a judgment against him, but you will still be faced with the task of collecting on it. Good luck.
Chris: Hello Joe,
This is Chris from HeadMetal Comics again?a few weeks back I ask you about copyright protection for my original comic series. Your response eased my concern, but now I?m wondering about something you said. You mentioned that it could be wise to purchase additional protection for new stories as new characters enter the story.
My question starts here: The original comic I purchased t
he copyright for has been redone by a new artist and the story has been lengthened to go far beyond just the origin story of my character. So if I send in this new lengthened story to be approved for copyright, will there be any red-flags raised when the people who issue the copyright see that there is a similar version of my story that is already protected by the USPTO? The copyright will still be registered under my name, however, the title we are going to use for the updated series is slightly different: the original title was simply BLUESEPH J. HEADMETAL. The new title is THE BLUESEPH J. HEADMETAL SAGA.
Sorry If I confused you. I confused me, kinda?=-)
Thanks Joe, and LegalZoom.
Joe Escalante: Since you are the owner of the underlying copyright, you will be allowed to control and register any derivative versions of it.
Janice: My husband and I moved out of a home we were renting here in San Antonio Texas?.we gave a 30 day notice but it was in person. We cleaned the house from top to bottom, never heard anything until 4 months later when we received an e-mail from the landlord stating we owed her over $3,000 for damages and because we never paid a deposit??that was not true, there were 2 broken mini blinds and one of them i told her about when we moved in and i also just found the receipt she gave us for the deposit?.does anyone in this area know of an attorney or someone i can call for help? PLEASE
Joe Escalante: This is a case for small claims court, where you appear without an attorney. You can consult one for advice, but they can?t appear for you. All this stuff has to be in writing. Whoever has the best evidence at the court will prevail. It sounds like you have at least something more than your opponent with your deposit receipt. Good luck.
Lynda: Good Morning Joe,
This question is regarding education law?
If a school adopts a program that rewards all its students, whom scores an advanced or better on their CST exams, can a teacher in that school adopt her own grading scale, for her class only, in tandem with this program to penalize any student who does not score an 83% or better with a 10% penalty?
Joe Escalante: As long as the penalty doesn?t involve any physical striking of the child, I can?t see a law being broken here. However, it may very well be against some school, or district policy. I wouldn?t know. Good luck.
Michael: Hey Joe! I have a friend who is considering bankruptcy, I told him that credit counseling might be better but he is basically way in over his head with credit card debt. What should he do in this situation? We are located here in NY.
Joe Escalante: This is credit counseling, rather than legal stuff, so I really couldn?t say.
Mark: I am in the middle of a kitcehn remodel?..the salesman for the co, said he could do some of the extra work i wanted done on the side. He ripped me off for $17,500 and had someone else do the work?..He was still a partner in this business when he did this to me and after the company he worked for found out, they fired him and 2 years later I am still waiting on getting the $$ from him??If I was going to take them to court?..could the company be held liabel?.? vicarious liability? ????
Joe Escalante: There?s a slim chance they could be liable if you could demonstrate that they should have known that this guy was acting in this capacity. But if this was a way to circumvent the company, you took a risk and you probably cannot get bailed out by them.
Robin: Will vs Trust. What is the difference and which is best?
Joe Escalante: A will just tells the court who gets your stuff after a lengthy probate process. A trust is an instrument you can use to avoid probate if you establish a trust and have the trust own your property. Then, when you die, your trust lives on. Instructions in the trust dictate where the property will go next so the courts don?t get involved. If you own property and have kids, it is pretty good to have a trust, in simple terms.
A trust should also include a will that allows for things not mentioned in the trust. So you have a trust, and a will is attached. It?s all just paper signed by people, and sometimes notarized, and then pulled out of a shoe box when you die.
George: The LegalZoom company formation questionnaire asks how much the initial founders of the corporations will be contributing (cash, services, property). Are founders required to contribute by law in proportion to their allotted shares? And how are ?services? and ?property? valued?
Joe Escalante: There are lots of ways to evaluate services and other contributions. My advice is to read up on this, because it?s important (see book below that might help), and your specific tax preparer should be consulted on these matters as they relate to your present situation and how your shares are going to be owned, or should be owned (e.g., as an LLC, or another corp, or as an individual). If it still doesn?t make sense, you may need to consult with an attorney, but after reading up on this stuff you at least wont be at their mercy as much. Good luck.
Thomas: What is the best all around corporation type set up for a freelance artist studio that plans to do everything from owning creator properties to publishing to providing artwork on freelance basis. Considering taxes, properties, equipment buying and all. thanks for your help.
Joe Escalante: Most of the time an LLC is the best way to go I?ve found, but you really need to consult with your tax guy to see what?s right for your exact situation. You can also ask tax questions to Gary the tax guy on Legalzoom?s Facebook page on Thursday. See the link below. This is new!!!!!
LegalZoom: Here?s the link, Thomas: http://zoo.mn/AskTheTaxPro
Sophia: im wonderin in the case of immigration and applying for a spouse whos been voluntarily removed.. is it better to reside abroad for hardship or to remain in the united states while applying for the I130 which is better?
Joe Escalante: These immigration laws are in flux right now so I wold only trust the advice of a practicing immigration attorney that is working in the trenches right now. If you are in Southern California, I recommend two smart girls at The Law Office of Molina & Molina, 2266 Zoe Ave. #201, Huntington Park, CA, 90255. 323-277-3280
Alexander: Question regarding musical copyright. Im a recording artist here in southern California. Im inquiring as to What type of form is required for musical compositions/recordings. Also what the fees if applicable would be ? Thank you much (bill handel referred me to legal zoom)
Joe Escalante: I haven?t memorized all the form numbers, or price list, but lucky for you all this is on the web site when you go through the process. It?s about $35.00. You can save some money by combining works into one CD as long as each song has the same author, or goup of authors. Registering a song as an author is a different form than registering a sound recording. You should check out my radio show. This is all we talk about. It?s actually on the air right now on http://www.indie1031.com.
Alayna: not sure where to start. does a public institution in a potential slander suit have the burden of proving a statement?s falsity?
Joe Escalante: In a defamation suit, the truth is almost always a valid defense. The defendant will have to prove that the statement was true if it was harmful and caused damages.
Nathan: What would be reasons a judge woulde grant a parent full custody??
Joe Escalante: One reason might be that the other parent is a pile and it would be in the best interest of the child to be under the full time custody of the non-pile parent. Having no place to live is a big one; obvious drug problem; living in a Mumbai slum might be another. If one parent moved far away, then the court would likely not want the kid flying every weekend, that kind of thing. Good luck.
Carol: My ex is on facebook and DOCSE have not been able to locate him and he owes me more than $120,000 in arrears. How should I handle this situation?
Joe Escalante: Try the District Attorney?s office.
Kim: Hi Joe. I have a 2 part question. I have an idea for an event that I want to plan. The event is for profit. Should I make this event a business and LLC right away (I want it to be a yearly event) or is that necessary? I really want to protect the name of the event also. I already own a small business and someone told me to just produce the event under my business. Sort of like?Tomboy Chic is the title sponsor of ABCD Event. Is that the route I should go? That?s the first question. Second, is it necessary to trademark the name of the event? Thanks!
Joe Escalante: Your friend is right, but speak with your tax adviser to be certain it?s right for you guys. Yes, trademark the event name if you think someone will steal it.
Carlton: Would you recommend a series LLC if I were to start businesses with significantly different activities (e.g., baking and bookkeeping) or would you recommend keeping it all under one roof (i.e., one LLC)?
Joe Escalante: This is best answered by your tax person after looking at your situation. Legally, it depends on the type of activities each is involved in. If some are high risk, it might be a good idea to keep them separated.
LegalZoom: You can ask a tax pro for free on Thursday, Carlton: http://zoo.mn/AskTheTaxPro
Shelia: I want to shop for a publisher for the book I have written. How do I know which are legitimate and which are not? I don?t want my material stolen.
Joe Escalante: You should call my radio show for a longer conversation about how this works but if you register your material with the U.S. Copyright office, you will at least have recourse if someone steals your stuff. Call the show. Thanks.
Tabatha: We make Braille shirts as a fundraiser for a 501(c)(3) we helped create www.CRB1.org If my husband and I pay for the materials to make the shirts, can the donation (price paid for the shirt) be a fully deductible donation for donors? Furthermore, can we deduct expense of materials to make shirts on our personal tax return as a charitable expense?
Joe Escalante: You need to go over this with your tax person. Or try Gary who answers questions here on Thursdays. Gary will set you straight. Thanks.
LegalZoom: Join us on Thursday: http://zoo.mn/AskTheTaxPro
Minister: Want to register a ministry?what do I need to do?
Joe Escalante: Look into registering with the state as a non profit corporation. Check with Gary the tax guy who answers tax questions here each Thursday. If it?s right for you, Legalzoom can help get it started.
Florentin: When Self-Publishing A Book (Music Book Containing Original Music):
1. Is there the need for a publisher name, or can it be published simply under the author?s name?
2. How does one go about ?registering? the book for an ISBN number?
3. What is the procedure for obtaining copyright for the included content?
Thanks!
Florentin
Joe Escalante: There?s no ?legal? reason for having a publisher name when self publishing. To get an ISBN number, click the link below.
To copyright the book, register it with the U.S. Copyright office. You can use legalzoom to help you with that if you are doing it for the first time.
Good luck!

I?m indigent, so the Judge advised that I would have to attend a State agency (Pathway?s-37-weeks), which I did, and also while on probation fro the 2nd D.U.I. I attended
another (37-week Clinical Evaluation) which my probation officer also gave me paperwork showing yet another completion, but when I got to the DDS the first thing I heard was, The State of Georgia (DOES NOT), except anything but DUI Intervention Program Registry Query! So with these facts what advice can you give me if any? Thank You in advance for anything you can Help me with. I?m trying to care for my 85yr. old parents, taking them wherever, buying groceries, going to the drug store,Doctors,Dentist ect?, You surly can see what a mess I?m in, and to date I?ve already paid $3000.00 plus dollars for court cost, probation, and now they want me to pay a $100.00 more for a Clinical Evaluation?!~ Please Help!
Joe Escalante: Each county in each state has different rules. I would have to have intimate knowledge of the rules in your county, sorry. I don?t have any answers. I could give you a b.s. answer but it seems like you?ve been through enough of that. Good luck.
Gerard: I feel my job suspended me without proper cause. 3 attorneys said that since the incident occured in 2009 my time ran out to act. but 1 said i could sue myself that i can present my case to the courts.. be help me with this one Joe..
Joe Escalante: I would go with the majority opinion here and move on. Litigation is to unhealthy to risk when the odds are against you this much.
William: What is the fastest way to get my late Dads estate in my name after my Mother put her husband whitch is not my father on my birth certificate.
Joe Escalante: The probate court will decide who owns what in your dad?s estate. They are so slow they could use only their own blood to type the forms without harming themselves.
