?Is anyone saying same-sex couples can?t love each other? I love my children. I love my friends, my brother. Heck, I even love my mother-in-law. Should we call these relationships marriage, too??-Rick Santorum

This is one of the most ridiculous things I?ve heard anyone say about gay marriage. Presumably, he is not in a romantic relationship with his children, friends, brother, or mother-in-law. I?m giving him the benefit of the doubt here, whether justified or not. His statement doesn?t even make sense to me. Is he denying that same-sex couples have a romantic relationship, which is why it makes sense to compare it to other non-romantic, non-sexual relationships? Or is he trying to suggest that, if people of the same sex are in a relationship, then they are also prone to having ?inappropriate? relationships with others in their lives?

?If the Supreme Court says that you have the right to consensual [gay] sex within your home, then you have the right to bigamy, you have the right to polygamy, you have the right to incest, you have the right to adultery. You have the right to anything. Does that undermine the fabric of our society? I would argue yes, it does. ? That?s not to pick on homosexuality. It?s not, you know, man on child, man on dog, or whatever the case may be. It is one thing.? USA Today interview

Okay, I was wrong. ?This one makes much less sense. I?m ?not even going to try to figure this one out. He can?t really be comparing gay sex to incest, can he? ?Ugh. ?Yes, I already know the answer to that. The scary thing is that, if he is the Republican nominee, there are a LOT of people who would blindly vote for him simply because he?s the nominee. I?m pretty sure my parents would, sad as that makes me. My mom, who lives in the South, told me, to my surprise, that if Obama was a good president, she would vote for him to have another term, yet she recently said she wouldn?t vote for him, feeling he hadn?t done anything to impress her. ?I?m pretty sure Rick Santorum wouldn?t either. Let?s just hope he doesn?t get that chance.

Justices take up heart of health care overhaul law

WASHINGTON (AP) ? The Supreme Court is taking up the key question in the challenge to President Barack Obama's historic health care overhaul: Can the government force people to carry insurance or pay a penalty?

The justices hear extended arguments on that topic Tuesday. It's the linchpin of the law's aim to get medical insurance to an additional 30 million people, at a reasonable cost to private insurers and state governments.

Virtually every American will be affected by the outcome, due this summer in the heat of the presidential and congressional election campaigns.

The administration says Congress has ample authority to impose the requirement that most people carry insurance or pay a penalty. Twenty-six states and a small business group trying to get the law struck down call the insurance requirement an unprecedented power grab by Congress.

They say that not even decades of high court rulings that endorsed an expansive view of congressional authority can support the health care law.

If upheld, the law will force dramatic changes in the way insurance companies do business, including forbidding them from denying coverage due to pre-existing medical conditions and limiting how much they can charge older people.

The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because its most disputed element, the insurance requirement, will provide insurance companies with more premiums from healthy people to cover their increased costs of care.

White House press secretary Jay Carney, traveling Tuesday with Obama in South Korea, reiterated the administration's contention that the health care law is constitutional, noting that the individual mandate provision had support among Republicans. However, Carney said, "The president feels that this is something for the court to decide, not for us to weigh in on directly."

The law also dramatically expands the state-federal Medicaid program for low-income Americans, with the federal government covering almost all the additional costs.

A 19th century law bars tax disputes from being heard in the courts before the taxes have been paid. The law could apply to the health care case because the insurance requirement doesn't kick in until 2014 and any penalties will be paid along with federal income tax on returns due by April 2015.

Solicitor General Donald Verrilli Jr., defending the health law, urged the court to focus on what he called "the issues of great moment" at the heart of the case. The states and the National Federation of Independent Business also want the court to go ahead and decide on the law's constitutionality without delay.

Administration officials involved with the defense and implementation of the health care law, Attorney General Eric Holder and Health and Human Services Secretary Kathleen Sebelius, were in the courtroom Monday. Republican Sen. Jeff Sessions of Alabama and Florida Attorney General Pam Bondi also were in the crowd that filled the courtroom's 400 seats.

Outside the packed courtroom, marching and singing demonstrators on both sides ? including doctors in white coats, a Republican presidential candidate and even a brass quartet ? voiced their eagerness for the court to either uphold or throw out the largest expansion in the nation's social safety net since Medicare was enacted in 1965.

Republican presidential candidate Rick Santorum declared anew that GOP front-runner Mitt Romney has no standing to challenge Obama on the law since Massachusetts passed a somewhat similar version when Romney was governor. "If you really want Obamacare repealed," Santorum said outside the court, "there's only one person who can make that happen."

Later Monday, Romney said again he would repeal the law, calling it an unconstitutional power grab.

Breast Cancer Gene Patent Case Involving Yale Plaintiff Heads ...

Written by Barbara Puffer The U.S. Supreme Court has ordered a federal appeals court to review its decision to grant patents to Myriad Genetics for two genes that are predictive for hereditary breast and ovarian cancer.

A lawsuit, challenging the patenting of BRCA 1 and BRCA 2 genes, was brought by the American Civil Liberties Union and the Public Patent Foundation, on behalf of 20 plaintiffs, representing more than 150,000 interested parties.? One of the individual plaintiffs is Ellen Matloff of New Haven, a research scientist in genetics at the Yale School of Medicine and director of Cancer Genetic Counseling at the Yale Cancer Center.

The suit challenged Myriad?s right to patent genes and set prices that ?lock out? some women from getting the test.? The suit claims that the patents unfairly limit both scientific research and patient options for genetic testing, and raises broad legal and ethical questions under the First Amendment about whether genes are ?products of nature? or commercial commodities. In July 2011, a federal appeals court upheld Myriad Genetics? gene patent eligibility?involving tests on isolated DNA in the BRCA 1 and 2 genes.? The ACLU appealed that decision to the Supreme Court.

This week?s order comes after a recent high court ruling that a blood test developed by Prometheus Laboratories of California, was not eligible for a patent because it was a ?simple application of a law of nature.?

?In light of recent rulings from the court that mere laws of nature cannot be patented, we hope that the lower court will come to the correct conclusion this time around,? said Chris Hansen, staff attorney with the American Civil Liberties Union (ACLU) Speech, Privacy and Technology Project.? ?It?s inconceivable that a company can own a patent on something as naturally occurring as DNA.?

?Preventing the free flow of ideas regarding genetic testing is not only unlawful, it is dangerous to patients,? said Sandra Park, staff attorney with the ACLU Women?s Rights Project.

Peter Meldrum, president and CEO of defendant Myriad Genetics of Salt Lake City, said in a statement posted on Myriad?s website that the company is ?? prepared to vigorously defend the patent claims granted to Myriad by the U.S. Patent and Trademark Office and believe that we will be successful.?? Meldrum doesn?t believe the ruling will have any direct impact to Myriad and its operations because of their ?extensive patent estate? and because ??it has great importance to the medical, pharmaceutical, biotechnology and other commercial industries, as well as the hundreds of millions of people whose lives are bettered by the products these industries develop based on the promise of strong patent protection.?

Daniel B. Ravicher, executive director of Public Patent Foundation and co-counsel for the plaintiffs, said, ?Nobody ?invents? genes, so no one should be able to claim ownership of them.? We are not talking about a new drug or a new tool to fight cancer. We are talking about a genetic marker that occurs naturally in the human body. That cannot, and should not, be patented.?

For women who have had breast or ovarian cancer before the age of 50, and/or have an immediate family member who has had one of these cancers, the BRCA 1 and BRAC 2 genetic test could be a lifesaver.? Yet many uninsured and underinsured candidates are finding Myriad?s monopoly testing costs out of reach.

Connecticut has the second highest incidence of female breast cancer in the nation ? with 2,920 new breast cancer cases diagnosed in 2008?and ranks 35th in the nation for breast cancer mortality.? The U.S Preventive Services Task Force estimates that 2 percent of all women ? or about 2,700 of the uninsured women in Connecticut?are likely candidates for the BRAC Analysis test.? Precautions can be taken by those who know they have the mutation.

Research shows that 5 to 10 percent of all breast cancers are in people who have inherited BRCA mutations. The mutations can signal a 60 to 85 percent lifetime risk for more than one primary breast cancer, and a 15 to 50 percent lifetime risk for ovarian cancer. The risk statistics for the general population are 12.2 percent for breast cancer, and 1.4 percent for ovarian cancer.

The testing also detects risk in men. If a man?s sister or mother has the BRCA 1 or BRAC 2 mutation, he has a 50 percent chance of also having it. Men carrying the mutation have a 6 to 7 percent chance of having male breast cancer, compared to less than 1 percent in the general population.

Since beginning their BRAC Analysis testing in 1996, Myriad has more recently added a second, related, patent-protected test called BART.? The BART test, so far, is not widely covered by any insurance, yet is deemed essential by many genetic counselors for those identified at risk for these cancers.

The tragic killing of Trayvon Martin has had Americans across the country rallying for justice. But rapper Game believes, as others do, that the 17-year-old's death is part of a deeply rooted racial issue.

"I think that from the beginning of mankind, we as a people have always been targeted," the Compton MC told MTV News on March 22.

On February 26, Martin was shot dead by neighborhood watchman George Zimmerman as he walked back to the home of a family friend in a gated Sanford, Florida, community. Zimmerman told police that he believed Martin — who was wearing a hooded sweatshirt — looked suspicious. After a call to 911, the dispatcher advised him not to pursue Martin. But Zimmerman reportedly ignored those instructions and pursued Martin anyway.

When police arrived on the scene, the teen was dead. Although Zimmerman admitted to the shooting, police declined to arrest him citing the state's Stand Your Ground law, which allows a person to kill in cases of self-defense. Trayvon's parents, community leaders and protestors were outraged and have been crying for justice ever since.

"For some, reason people don't think that they need any excuse to kill us, beat us, hit us, run us over, disrespect us or anything like that," Game said of the country's history of racial tension and violence.

"I'm far from racist," he continued. "I'm very educated and intellectual and I understand how life works and how people of all colors exist under the sun, but it just seems like more than not black people are, I don't know, there's always some negative occurrence that goes on in our existence. This is just another reminder that stupidity still exists."

On Monday, the Orlando Sentinel reported that unidentified investigators in the case told them that Zimmerman had a different take on the events of February 26. The 28-year-old told law enforcement that Martin struck him and bashed his head on the ground before he shot the teenager in the chest, killing him.

SILIVRI, Turkey -- The trial of a Turkish former armed forces chief accused of heading a terrorist group is due to begin on Monday.

General Ilker Basbug branded the case against him as tragi-comic when he was first detained in January. While bewildered by the accusations, he said he was not shocked, given how prosecutors have pursued other officers in the past three years.

Basbug, chief of staff from 2008 to 2010, is accused of being a leader of a shadowy network dubbed "Ergenekon", said to be behind a string of alleged, but as yet unproven, plots against the government of Prime Minister Tayyip Erdogan.

Ex-head of NATO's 2nd-largest army held over plot

Ilkay Sezer, the?general's lawyer, is expected to ask for the case to be transferred to the Supreme Court, as befitting a state official of Basbug's seniority, though earlier requests were rejected.

The 68-year-old retiree is the most senior officer among hundreds of secularists facing conspiracy and terrorism charges.

For many Turks it had appeared increasingly likely that the special prosecutors, given free rein to investigate by the government, would work their way to the top of the military chain of command in their hunt for anti-government conspiracies.

During his pre-trial detention Basbug has shared a cell with two other generals in the top-security prison at Silivri, west of Istanbul, where a courtroom has been specially built to hear Ergenekon- and "Sledgehammer"-related cases.

War game or blueprints for a coup?
Police say they discovered Ergenekon when they seized a secret arms cache in 2007, yet many Turks still doubt it exists.

Basbug is just a witness in the Sledgehammer case, which revolves around a 2003 seminar that prosecutors say contained blueprints for a coup, though the military says it was just a war game. Some 365 people are being tried in the case.

Turkey's generals traditionally saw themselves as guardians of the secular state envisaged by the republic's founder, soldier-statesman Mustafa Kemal Ataturk. Like the judiciary, they distrusted Erdogan and other members of the Justice and Development Party (AKP) with an Islamist past.

The military staged three coups between 1960 and 1980 and forced an Islamist prime minister, Necmettin Erbakan, to quit in 1997. These days, however, it is Erdogan who cracks the whip in Turkey as he enters his second decade in power.

'Black propaganda'
On April 4, the court in Ankara will hold the first hearing in the trial of generals who led the 1980 coup, including 94-year-old former military chief and ex-president Kenan Evren.

The case against Basbug features websites allegedly set up by the military to spread "black propaganda" against the government until 2008.

Tension between the military and the AKP was running high in 2007 when the generals opposed the nomination of Abdullah Gul for the presidency because of his Islamist pedigree. They never regained their clout after failing to cow Erdogan and Gul.

With strong public support, the AKP government brought the military to heel with democratic reforms. Endless investigations into coup plots tarnished the image of the once untouchable top brass.

Basbug has denied the charges against him, and his lawyer told Reuters earlier this month that the indictment was filled with inconsistencies and lacked credibility.

Scientists from the University of Gothenburg, Sweden, have investigated how much carbon the natural forests of Sri Lanka contain. The results are important for work to reduce deforestation of tropical countries, and for international negotiations in climate policy relating to a new climate agreement.

Global deforestation can be reduced by measuring the amount of carbon contained in natural forests. The measurements may make it possible for tropical countries to receive compensation from developed countries for the retention of forests.

Deforestation is responsible for approximately 12% of global greenhouse gas emissions. Most deforestation takes place in tropical forests, and it is important, therefore, to reduce the felling of such forests, in order to reduce total emissions of greenhouse gases.

Short-term profitability

One problem is that felling trees often gives a greater profit in the short term than allowing the forest to remain. However, it is possible to change the economic conditions such that countries can profit by allowing forests to stand.

Climate negotiations led by the UN in recent years have discussed a way of reducing global deforestation known as REDD+. This involves tropical countries being paid by developed countries if they retain or increase their tropical forests.

"But in order for REDD+ to work in practice, it's important to develop efficient systems for measuring the carbon in the forests, and such systems are deficient in Sri Lanka", says Eskil Mattsson, research student in physical geography at the Department of Earth Sciences, University of Gothenburg.

The carbon content of trees

One aspect of the work he has carried out in collaboration with Swedish and Sri Lankan colleagues involves measuring the carbon content of various types of natural forest in Sri Lanka. This meant carrying out measurements on approximately 20,000 trees. The results show that deforestation is responsible for nearly half of the greenhouse gas emissions that originate from human activity in Sri Lanka. There are, however, large differences between the amounts of carbon that different types of forest contain.

"The calculations are important in order to estimate the costs and benefits of reducing deforestation, since the levels of compensation will be based on the amount of carbon in the forest", says Eskil Mattsson.

Alternatives to felling

Eskil Mattson's studies have also shown that it is possible to use other ecosystems than natural forests to bind carbon and to provide food, timber and protection against climate change for the local population.

His work can be used, among other things, to reach a clearer understanding of how Sri Lanka and other tropical countries can retain natural forests in order to reduce the emission of greenhouse gases without a detrimental effect on the opportunities for the local population to support itself.

The results are also significant for international negotiations in climate policy, and for a new climate agreement in which issues relating to the measurement of carbon in forests and soil are high on the agenda.

The thesis "Forest and Land Use Mitigation and Adaptation in Sri Lanka Aspects in the Light of International Climate Change Policies" will be defended at a disputation on 30 March 2012.

Charges filed against Chevron execs in Brazil

SAO PAULO (AP) ? Federal prosecutors filed criminal charges against 17 Chevron and Transocean company executives on Wednesday for an oil leak in the Atlantic, a move deemed outrageous by those targeted but applauded by environmentalists.

Prosecutors accused the executives of environmental crimes, of misleading Brazil's oil regulator about safety plans and of not providing accurate information in the wake of the spill.

At least 110,000 gallons (416,000 liters) of oil seeped through cracks on the ocean floor near a Chevron Corp. appraisal well off the Rio de Janeiro coast in November. The well drilled by Transocean Ltd. has since been sealed, but a small amount of seepage reappeared in recent days, raising concern the damage is not yet over.

The federal prosecutors' office in Rio de Janeiro said in an emailed statement that the two companies and 17 of its executives have been charged with "crimes against the environment." Executives could face up to 31 years in prison. A judge will decide if the case will go to trial, which would be a lengthy process given the number of defendants, the complexity of the case and the Brazilian legal system's room for numerous appeals.

"These charges are outrageous and without merit. Once all the facts are fully examined, they will demonstrate that Chevron and its employees responded appropriately and responsibly to the incident," said Chevron spokesman Kurt Glaubitz. "Chevron will vigorously defend the company and its employees."

Prosecutor Eduardo Santos de Oliveira, however, said that "Chevron and Transocean have caused a contamination bomb with a prolonged effect."

The charges come as Brazil works feverishly to develop massive offshore oil fields discovered in recent years, discoveries that hold upward of 50 billion barrels of oil and that officials are counting on catapulting the nation permanently into developed-world status.

Some fear that the tough stance against Chevron will discourage much-needed foreign investment into developing the fields. While Brazil's state-controlled oil company Petrobras is considered by many as the globe's leading developer of offshore finds, the sheer volume of the oil reserves means the company cannot fully produce them alone.

"If you start locking up executives, people back in other oil companies like Shell, BP, ENI and anyone else with a concession in Brazil will notice and become wary," Eric Smith, an offshore oil expert at Tulane University in New Orleans.

But others think there is simply too much money to be made in Brazil's oil bonanza to scare off companies, and say this case doesn't reflect a newly aggressive attitude toward Big Oil.

"I don't see this as reflecting an anti-foreign company stance by the government nor do I think it will be seen as such by investors," said Christopher Garman, U.S.-based Eurasia Group consulting firm. "I don't see this having an impact on the interest of investors investing in Brazil."

Garman noted that Brazil's prosecutors are independent of interference from the government and that President Dilma Rousseff, herself a former chairwoman of the board of directors at Petrobras, remains committed to filling Brazil's coffers with oil revenue.

Among those charged Wednesday with environmental crimes are six Americans, five Brazilians, two French and Australian nationals, one British citizen and one Canadian. They include the heads of the Brazilian subsidiaries of both Chevron and Transocean.

George Buck, chief operating officer for Chevron's Brazilian division and three other Chevron executives have also been charged with providing authorities with a "deceptive" emergency plan and "altering documents delivered to government officials," according to prosecutors' statement. It didn't provide more details.

"The leak affected the region's maritime ecosystem, could lead to the extinction of species and jeopardize the area's economy," the statement said.

Prosecutors asked that that all the assets of those charged be seized, that each person be fined $555,555 and each company $5.6 million. A judge ruled late last week that none of the executives could leave Brazil.

Chevron said after the November leak that it had underestimated the pressure in an underwater reservoir, so that crude rushed up a bore hole and eventually escape into the surrounding seabed some 230 miles (370 kilometers) off Rio's coast. The oil escaped through at least seven narrow fissures on the ocean floor, all within 160 feet (50 meters) of the well head.

"Everything indicates that Chevron was imprudent and that area should not have been developed," said Carlos Minc, the environment minister for Rio de Janeiro state. "The porous seabed has dozens of fissures and faults through which oil seeps."

Minc stressed that the geographic studies of the area of the appraisal well required extreme caution and extra safety measures.

Asked if the government was overreacting because Chevron is a foreign company, Minc said: "I don't think it (the reaction) was excessively rigorous."

He said Petrobras has also been fined for leaks.

"I do not see any 'Chavismo' here," he said referring to Venezuelan President Hugo Chavez's contentious relationship with foreign oil companies.

Rousseff said in a Wednesday speech that foreign oil companies operating in Brazil must "abide by the safety regulations and know they must stay within security limits and sometimes below security limits but never go beyond them."

Rousseff spoke at the inauguration of Magda Chambriard as president of Brazil's National Petroleum Agency. She did not mention either Chevron or Transocean.

Oliveira said the two companies failed to adopt procedures to contain the leak. He wrote that those expected to face charges didn't halt drilling operations soon enough and that when questioned they said the risks involved "were acceptable."

Oliveira says Chevron and Transocean "altered the truth" in documents presented to authorities, such as the number of ships deployed to contain the leak.

"The reckless operation that led to the environmental damage was planned or approved by all (the 17)," Oliveira. "They knew they were drilling in a high-pressure area and that the walls of the well could not withstand that pressure."

Transocean owned the Deepwater Horizon rig that oil company BP PLC was leasing at the time of last year's Gulf of Mexico oil spill, the largest in U.S. history and one that dwarfs the Brazilian leak. At its peak, BP's Macondo well was spewing more than 7.5 million liters a day.

Brazil itself has had bigger oil spills than this one.

In 2000, crude spewed from a broken pipeline at the Reduc refinery in Rio de Janeiro's scenic Guanabara Bay, spewing at least 1.3 million liters into the water. Just a few months later, more than 3.8 million liters of crude burst from a pipeline operated by state-controlled oil company Petrobras into a river in southern Brazil.

Brazil's worst oil disaster was in 1975, when an oil tanker from Iraq dumped more than 30 million gallons of crude into the bay and caused Rio's famous beaches to be closed for nearly three weeks.
